COUNTIES ENERGY OUTAGE APP TERMS AND CONDITIONS

These terms and conditions apply to your access to and use of Counties Energy Limited’s (Counties Energy) mobile outage app (App). By installing or using this App you accept these terms and conditions.

USE AND AVAILABILITY

1. You may only use this App for personal use.

2. Counties Energy does not guarantee the operation of this App will be continuous, complete or error free. Counties Energy may modify this App, or cancel or suspend the availability of this App, at any time.

CONTENT

3. Use of the information and data contained on this App is at your sole risk. While Counties Energy has taken reasonable care in preparing the information and data contained on this App it is provided on an “as is, as available” basis without warranty of any kind. You should note that information and data contained on this App may not necessarily apply in your particular circumstances.

4. Counties Energy may choose not to provide outage information on the App for any reason. In particular, Counties Energy may withhold information for safety or privacy reasons.

LINKS TO OTHER APPS OR SITES

5. Counties Energy is not responsible for the information or content of any other app or any website that is linked to or accessed by this App. Counties Energy does not provide any endorsement, approval, representation or warranty about any products or services that are offered by the owners of other apps or websites.

6. By using the App, you are bound by the Google Maps/Google Earth Additional Terms of Service (including the Google Privacy Policy).

DATA

7. Counties Energy may collect and use technical data and related information, including technical information about your mobile device, system and application software, and peripherals, to facilitate the provision of software updates, product support and other services to you related to the App. Counties Energy may use this information to improve the App or its services or to provide additional services to you.

LOCATION

8. If you agree, Counties Energy may collect your location information in the App and use this information to allow you to view the outages near your location.

INTELLECTUAL PROPERTY

9. Counties Energy, or its licensors, owns all copyright in all material on this App. The brands appearing on this App are trademarks of Counties Energy or its owners. Counties Energy reserves all rights in such material. You must not reproduce any content on this App without first obtaining Counties Energy’s written permission.

10. You must not copy, reproduce, decompile, create derivative works of, reverse engineer, modify, sublicense, distribute, display or use for any other purpose this App or other intellectual property or attempt, or authorise or permit any other person to do so.

CHANGES

11. Counties Energy can change these terms and conditions from time to time on not fewer than 14 days’ notice by notifying you through this App. If you do not want to be bound by the amended terms and conditions, you should uninstall this App before the changes take effect.

PRIVACY

12. Counties Energy’s privacy policy describes how Counties Energy collects, uses and manages personal information that Counties Energy collects from you. By installing or using this App you agree to the terms of Counties Energy’s privacy policy. If you do not agree to the privacy policy you must stop using this App. Counties Energy’s privacy policy can be viewed here.

13. In addition to providing services to you, you agree that we may use your information for the purpose of providing you with promotional material on our other services and special offers by email or other promotional means.

LIABILITY

14. Counties Energy, its agents, officers and employees:

(a) make no representations, express or implied, about the accuracy of the information and data contained on this App;

(b) make no representations, either expressed or implied, as to the suitability of information and data contained on this App for a particular purpose;

(c) make no warranties, express or implied, that information or data contained on this App is free of infection by computer viruses or other contamination; and

(d) to the maximum extent permitted by law, will not be liable to you for any damages, losses (including, without limitation loss of profits, business or data), costs or expenses of any kind, which arise out of, or result from, any use of, or inability to use, this App, including any damages, losses (as described above) or costs that may result from use of information or data contained on this App or any reliance placed on that information or data.

JURISDICTION

15. This App is governed by, and is to be interpreted in accordance with, New Zealand law. Any disputes between us will be resolved by the New Zealand courts. To the fullest extent permitted by law, we accept no responsibility for the compliance of this App or the information contained in it with the laws of any other country. You agree to indemnify and keep us indemnified against all damages, costs, losses (including, without limitation, loss of profits) and expenses of any kind, whether direct or indirect, which arise from or in connection with your access or use of this App, whether in tort, contract, equity or otherwise.

FACEBOOK COMPETITIONS

Our Facebook competitions are in no way sponsored, endorsed or administered by, or associated with, Facebook. Facebook are completely released from any liability to any entrant to the Draw. Any questions, comments or complaints regarding the Draw will not be directed to Facebook but to the Promoter at promo@countiesenergy.co.nz. All prize packs must be collected from Counties Energy Ltd, 14 Glasgow Rd, Pukekohe between the hours of 8am – 4pm Mon – Fri unless otherwise stated. All tickets that cannot be provided electronically must be collected at the outlined address above.

CUSTOMER SURVEY FOR SERVICES SEPTEMBER 2025

These terms and conditions apply to anyone who chooses to enter the Counties Energy ‘Services Survey’ prize draw. By entering this promotion, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.

Counties Energy may cancel, terminate, modify, or suspend the Draw (as described below) or these terms and conditions at any time and for any reason before Sunday 26 October 2025.

How to enter

To enter the prize draw, you must be a current Counties Energy customer, aged 18 years or over, and have completed and submitted the Counties Energy ‘Services Survey’ online survey in full, before the survey response cut-off date of Sunday 26 October 2025.
You are deemed a current Counties Energy customer if your current address is in the area managed by Counties Energy for electricity distribution services, see our network map here.
The Counties Energy ‘Services Survey’ online survey is available for completion from Monday 29 September 2025 until 11:59pm on Sunday 26 October 2025 (the “Promotion Period”).
All eligible survey entries will be entered into a Prize Draw (the “Draw”) at the end of the Promotion Period.
The Draw is offered by Counties Energy Limited, 14 Glasgow Road, Pukekohe.
All employees and directors of Counties Energy Limited and all trustees of the Counties Energy Trust (and the immediate families of these persons) are not eligible to enter the Draw.
Multiple completed surveys submitted from the same person, will be entered into the Draw only once.

The prize

There are five (5) grocery voucher prizes to the value of $300 each to be won.
Each winner needs to select, by completing the optional ‘Which supermarket would you prefer grocery vouchers for, should you become one of our five lucky winners?’ question in the Services Survey, which ONE of the following supermarket chains they would like their $300 of vouchers for: Either Woolworths, PAK’nSAVE, or New World.
Counties Energy will arrange for each winner’s $300 selected grocery voucher prize to be available to be picked up by the winner from the Counties Energy offices located at 14 Glasgow Road, Pukekohe, on an agreed date on or before Friday 14 November 2025. Should a winner not be available to pick up their vouchers prize by this date, their prize will be held at the Counties Energy offices until Friday 21 November 2025.
Each $300 gift voucher prize is non-transferable, non-refundable, and cannot be redeemed for cash.

The prize draw

The three (5) winning entries will be drawn at random from all qualifying entries on Friday 31 October 2025.
Counties Energy will make all reasonable efforts to notify the winners of the Draw, using the contact details supplied, within three business days of the Draw taking place.
If Counties Energy is unable to contact any of the winners within this time frame, the Prize(s) will be redrawn.
Counties Energy’s decision on all matters relating to the identification and confirmation of Prize winners is final and no correspondence will be entered into.

Collection and use of information

Counties Energy will collect and store all entrants’ names, email addresses, and phone numbers supplied as part of this prize draw. Counties Energy’s privacy policy will apply to this information: see https://countiesenergy.co.nz/privacy-policy/.
The information collected will be used by Counties Energy for the purposes of carrying out the Draw, as well as for future marketing purposes.
Future marketing purposes may include, but are not limited to, invitations to participate in future surveys. You may contact us to be removed from this list at any time.

If you win a Prize, you agree to Counties Energy using your name, likeness, image and/or voice (including photograph film and/or recording of the same) in any media only for the purpose of announcing the winners.

CUSTOMER MONTHLY FAULTS SURVEY 2025

These terms and conditions apply to anyone who chooses to enter the Counties Energy monthly ‘Faults’ survey prize draw. By entering this promotion, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.

Counties Energy may cancel, terminate, modify, or suspend the Draw (as described below) or these terms and conditions at any time and for any reason before Sunday 12 October 2025.

How to enter

To enter the prize draw, you must be a current Counties Energy customer, aged 18 years or over, and have completed and submitted the Counties Energy monthly ‘Faults Survey’ online survey in full, before the survey response cut-off date of Sunday 12 October 2025.
You are deemed a current Counties Energy customer if your current address is in the area managed by Counties Energy for electricity distribution services, see our network map here.
The Counties Energy ‘Faults Survey’ online survey is available for completion from Monday 6 October 2025 until 11:59pm on Sunday 12 October2025 (the “Promotion Period”).
All eligible survey entries will be entered into a Prize Draw (the “Draw”) at the end of the Promotion Period.
The Draw is offered by Counties Energy Limited, 14 Glasgow Road, Pukekohe.

There is one (1) Prezzy Card prize of $100 to be won.
To enter the draw, please complete the optional ‘Promotion Entry’ section at the end of the Faults Survey before submitting the survey.
Counties Energy will arrange for the winner’s $100 Prezzy Card prize to be picked up by the winner from the Counties Energy offices located at 14 Glasgow Road, Pukekohe, on an agreed date on or before Friday 24 October 2025. Should a winner not be available to pick up their vouchers prize by this date, their prize will be held at the Counties Energy offices until Friday 31 October 2025.
The $100 Prezzy Card is non-transferable, non-refundable, and cannot be redeemed for cash.

Counties Energy will make all reasonable efforts to notify the winner of the Draw, using the contact details supplied, within three business days of the Draw taking place.
